Lottery Rules

ONERHT Foundation Ltd (the “Foundation”) is pleased to organise a fundraiser lottery (the “Lottery”) on the occasion of the FCCS 2024 Gala Dinner (the “Gala”), the rules of which are as follows (these “Rules”). For purposes of these Rules, “FCCS” refers to the French Chamber of Commerce in Singapore.

All capitalized terms used herein shall have the meaning ascribed to them in these Rules.

1. Participation

Only Eligible Persons will be entitled to buy Tickets and participate in the Lottery. The correct matching of the Ticket number (which will be printed on the Ticket) with a winning number drawn under these Rules shall qualify the Participant for the Prize associated to such draw as provided in these Rules.

2. Eligibility Criteria

Tickets will be offered to members of FCCS and attendees of the FCCS 2024 Gala Dinner only (the “Eligible Persons” which shall exclude the Excluded Persons). Each purchaser shall provide its/his/her name, NRIC No. / FIN No. / Passport No. (for individuals) or UEN No. (for corporations and other entities) and email address to FCCS and/or the Foundation upon purchase. Tickets may only be sold by the Foundation, or FCCS on behalf of the Foundation.

Purchasers of the Tickets can be individuals, corporations or such other entities.

No person under the age of eighteen (18) years shall be allowed to purchase a Ticket or to claim any Prize in connection with a winning Ticket under these Rules.

The following persons (the “Excluded Persons”) will not be allowed to participate in the Lottery:

4. Lottery tickets

Numbered tickets will be issued by the Foundation for purposes of the Lottery (the “Tickets”) and offered at a price of S$40 per Ticket.

All payments for the Tickets shall be collected by the Foundation (or FCCS on behalf of the Foundation). Payment for the Tickets shall be made (i) in cash, (ii) through Pay Now at UEN S79SS0054B or (iii) by transfer to the following FCCS bank account: 141081729001 with HSBC LTD, 9 Battery Rd Singapore 049910.

Tickets may be gifted but are not for resale. Tickets are bearer tickets and the Foundation is not obliged to ascertain whether the bearer of the Ticket is the rightful holder of the Ticket. The Foundation’s decision on ownership of winning Tickets shall be final and conclusive.

For the avoidance of doubt, the Foundation may in its sole and absolute discretion, reject any requests made for purchases of Tickets. Once purchased, Tickets will not be refunded.

No person shall be recognised by the Foundation as holding any Ticket upon trust or as an agent or representative for some other person or persons and the Foundation shall not be bound or required to recognise any right, interest or claim in respect of any Ticket other than the absolute right of the holder of the Ticket, to the entire Ticket.

For purposes of these Rules, “Participant” means a person who takes part in the Lottery by purchasing a Ticket, and shall include any person who claims a Prize or refunds from the Foundation.

5. Prizes

The Prizes of the Lottery (the “Prizes” and each a “Prize”) shall be:

  2. Club Med: Club Med Kani, Maldives, 4D3N, for two persons
  3. Diptyque: Exclusive 34 boulevard Saint Germain – Scented wax centrepiece
  4. Longchamp: Roseau XS Bucket bag, Violet
  5. Odette: A signature menu by 3 Michelin star chef, Julien Royer, with a glass of champagne on arrival, for two persons
  6. One&Only Desaru Coast: 4D3N stay for two persons, including dinner at Hoshi Restaurant & two spa massages
  7. Pernod Ricard: 9L Salmanazar Champagne, Perrier-Jouët : Belle Epoque, Millesime 1999
  8. Raffles Hotel Singapore: IMUA dinner experience at Butcher’s Block, inclusive of wine pairing, for two persons
  9. Société Générale: Travel voucher for two persons

6. Drawing

The drawing process will be conducted onstage during the FCCS 2024 Gala Dinner to be held on 12 April 2024 at the Shangri-La Hotel, and will be attended by the Independent Scrutineer.

A draw will be carried out for each Prize. For each draw, the pool from which the winning number will be drawn shall comprise the numbers corresponding to all the Tickets sold, provided that the numbers of the Tickets having won a Prize shall be excluded from the pool from which the following Prizes will be drawn. No Ticket shall be entitled to more than one Prize.

If during the course of any draw, any fault or failure shall occur in any associated equipment utilised for such draw, the Foundation may in its absolute discretion declare such number or numbers as duly drawn or so much of the draw as at such time been completed as void and commence a new draw whether using the same equipment or otherwise. Upon the declaration of a draw as void as aforesaid, the same shall be deemed not to have taken place.

7. Notification Process and Prize Collection

To be validated as a winning Ticket, a Ticket must (i) be an original Ticket, (ii) bear the winning number, (iii) have been issued by the Foundation, (iv) satisfy all the Foundation’s checks for that Ticket, (v) not be torn, mutilated, defaced or disfigured in any way, (vi) not be altered or tampered with in any manner, and (vii) not be recorded as cancelled by the Foundation.

In case of presentation of two or more alleged winning Tickets for any given Prize at the Gala, the Foundation may at their sole discretion decide to (i) deliver the Prize to one of the alleged winning Ticket holders, (ii) re-draw the contested Prize or (iii) postpone attribution of the Prize.

The Foundation’s decision as to whether or not a Ticket has satisfied all the conditions in this Rule 7 and any decision of the Foundation hereunder shall be final and conclusive and shall be binding on the person presenting that Ticket for collection of a Prize.

Winners must collect their Prizes onstage during the Gala, upon presentation of the original Ticket bearing the winning number. Should any winners not be in attendance at the time the Prizes are drawn, they will be notified via email within seven days following the Gala, pursuant to the Gambling Control (Fundraisers – Class License) Order 2022, and their respective Prizes will be made available to them against delivery of the original Ticket bearing the winning number at the FCCS offices.

Such winners are to contact FCCS at gala@fccsingapore.com or +65 6933 1350 between 10 am and 4 pm on weekdays to arrange for Prize collection.

The Foundation shall publish the particulars of winning tickets on its official website for a period of 2 months following the Gala.

All winners will have to present their NRIC, Work Pass or Passport upon collection of their Prizes.

All Prizes must be collected from FCCS’ office by 12 May 2024. The collection of any Prize won by a Ticket to the person presenting that Ticket shall constitute a complete discharge of the Foundation’s liability in respect of that Ticket.

Uncollected Prizes by the specified date shall be donated to such charity(ies) as agreed between FCCS and the Foundation.

8. Prize Terms

Prizes are non-transferable and non-exchangeable for cash and may be subject to availability.

The Foundation reserves the right to replace any Prize with cash and/or another item.

All prizes, regardless of their nature, will be distributed on an as-is basis and no warranty of any kind will be given by FCCS or the Foundation on the Prize.

9. Alteration and Cancellation

The Foundation reserves the right to interpret and enforce these Rules as it deems necessary for the fair and smooth conduct of the Lottery.

The Foundation may at its discretion and at any time alter the price of the Ticket and/or the Prizes offered for a particular draw or the entire Prize structure of the Lottery.

The Foundation shall have the right to cancel the Lottery, in whole or in part, at any time until the Gala date (inclusive), in particular if it appears that fake Lottery tickets are in circulation. In such a case, the ticket purchase price paid by Pay Now or bank transfer will be refunded and ticket purchase price paid in cash shall be deemed as a donation to the Foundation.

In such a situation, Prizes will be returned to the sponsors.

The Foundation also reserves to right to vary, supplement or replace any of these Rules at any time before, during or after the Gala.

10. Dispute Resolution and Applicable Law

All disputes not specifically covered by these Rules may be referred to the Foundation whose decision thereon shall be final and conclusive. All decisions of the Foundation regarding the Lottery and these Rules shall be taken after consultation with FCCS.

The Lottery is conducted in compliance with the laws of the Republic of Singapore, including the Gambling Control (Fundraisers – Class License) Order 2022.

The Courts of the Republic of Singapore shall have non-exclusive jurisdiction over any and all disputes arising out of or in connection with the Rules, including but not limited to disputes as to the validity or interpretation of the Rules.

11. Verification Process

Mazars has been appointed as independent scrutineer (the “Independent Scrutineer”) and will attend the draw during the Gala and issue the Independent Scrutineer’s statement pursuant to the Gambling Control (Fundraisers – Class License) Order 2022.

12. Liability

The Foundation and FCCS, their respective directors, officers, agents or servants shall not be liable for any loss, damage, costs, charges, fees or expenses of whatsoever nature and howsoever arising, whether direct, indirect, joint, several, actual, contingent or otherwise suffered, incurred or sustained by a Participant arising out of or in connection with the Lottery for any reason whatsoever, including but not limited to:

Each Participant hereby agrees and consents to the Foundation, FCCS and the Independent Scrutineer collecting, holding, disclosing, transferring and processing such personal data (as defined in the Personal Data Protection Act 2012) (“PDPA”) as provided by such Participant (including without limitation keeping file copies of passports and Singapore NRICs, where applicable), for purposes in relation to the Lottery, or for use in FCCS’, the Foundation’s or the Independent Scrutineer’s written or electronic public communications, including but not limited to FCCS’, the Foundation’s or the Independent Scrutineer’s annual reports, pamphlets, brochures, newsletters and webpages, or for such other purposes as may be required under the PDPA.

By participating in the Lottery, participants agree to comply with and abide by these Rules and all instructions, directions and procedures established by the Foundation for the conduct of the draw and the Lottery.
